Terms and ConditionsTerms and Conditions: When registering on the website and entering a competition via the website an entrant is accepting that they have read these terms and conditions and agrees to be bound by them.
- Qualifying Persons
1.2 – The competitions are open to private individuals (e.g. not companies) aged 18 and over excluding The Promoter and their employees.
1.3 – The Promoter reserves the right to close a customer’s account at any time, if they feel the customer is 1. abusing any services offered. 2. Being abusive to other customers or staff directly or on any social media platform. 3. They have belief that it is not genuinely the customer registered that is entering.
1.4 – The Promoter reserves the right to refuse a customer’s entry at their own discretion.
- Legal Undertaking
2.2 – These Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.
2.3 – In the event that you participate in a Competition online via our Website, and by accepting these Terms and Conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any entrant entering any of our Competitions unlawfully. If in any doubt you should check with the relevant authorities in your country.

3.2 – Availability and pricing of Competitions is at the discretion of the Promoter and will be specified at the point of sale on the Website.
3.3 – In order to enter a Competition, you will first need to register an account with us. You can register an account online via the website. When registering an account online you will be asked to provide an email address and secure password.
3.4 – In answering the Question, the Entrant recognizes that they must exercise Skill, Knowledge and Judgement to give the correct Answers; if answered incorrectly, The Entrant will not be included in the draw.
3.5 – A maximum number of entries are stipulated within each Competition via the “number of tickets” drop down box. This is the maximum entries permitted per Entrant for the particular competition.
3.6 – To conclude an entry into the Competition, an Entrant will be asked to provide their contact details (including postal and e-mail addresses and a telephone number) and card payment details (for entry fee only). Once the Entry is submitted, the Entrant’s card payment will be electronically approved via our merchant provider “Trust Payments”
3.7 – When the Maximum Number of Entries is reached, the Competition will close; however, the Promoter reserves the right to extend the closing date at its discretion.
3.8 – All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date or if the Promoter decides to cancel the competition due to lack of participation.
3.9 – The Promoter’s decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner.
3.10 – Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.

5.2 – If the Winner cannot be contacted by the Promoter within 7 days of being notified of their status as the Winner by e-mail, telephone, Facebook or mail via the contact details submitted along with their entry, then the Promoter reserves the right to then select an Alternate winner, who will then have 7 days to accept the prize following the same routes of contact as the original Winner. The original winner will have no claim to the prize after the Alternate Winner is selected.
5.3 – The Promoter has the right to cancel a competition at any time and refund entrants.

6.2 – Full details of the close of a competition will be confirmed once the date has been decided via Facebook and or our website.
6.3 – Winners details may be displayed on our Facebook page – Luxe Instants and/or our website.
6.4 – There will only be one main prize winner per competition unless otherwise stated.
6.5 – If the contest is for a car and is completed and the Prize is issued successfully then the prize will be transferred by the Promoter to the winner of the contest using the V5 for each car. This must be completed before the car is handed over. The winner is responsible for taxing and insuring the vehicle as required and the Promoter will have no responsibility over the Prize(s) once hand over is completed. The Promoter is not responsible for paying export or import taxes or costs if the winner lives outside the UK.
7.2 – The Promoter does not imply or give any warranty or accept any valuation to the Prize or guarantee the road worthiness in anyway shape or form. The Entrant must make up their own decision through their own enquiries and legal advice before entering the competition.
7.3 – The prize will only be that as awarded at the time of the draw, no alternatives will be offered under any circumstance.
7.4 – Collection of the prize is the sole responsibility of the winner, from the Promoter’s address unless otherwise stated by the Promoter.
7.5 – The winner may be required to provide proof of identity to collect or take delivery of the prize and proof of entry into the competition at the time that the prize is collected/delivered.

9.2 – Save for death or personal injury the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize; The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.
9.3 – The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.
9.4 – The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket coordinates recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event. 9.5 – No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.
9.6 – These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoters.
9.7 – An entry shall be declared void (without any refund being given) if the entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the Website.

11.2 – Acceptance of the prize by the Winner will mean they are asked to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule 6.3, unless prohibited by law.
11.3 – By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses) and as required by the Promoter if you are declared a Winner.
